Development Review – Contract Rezoning Agreement Dan Waldron, applicant, doing business as WhiteCAP Builders, request for a contract rezoning agreement for the former Three Tides Restaurant property located at 2 Pinchy Lane, Map 1, Lot 141B. Mr. Waldron is proposing to renovate the building to expand restaurant seating into the third floor (formerly a residence) and to construct stairwell improvements to the upper floor. Some of the proposed improvements encroach on the 10 foot structure setback requirement, thus, he is requesting a contract rezoning agreement to reduce setback requirements pursuant to Ordinance provisions for the Water Mixed Use zoning and Waterfront Development shoreland districts.
